This Privacy Policy (hereinafter referred to as the “Privacy Policy”) applies to all information that the Dogsnavigator Website and the Dogsnavigator App may receive about the User while using the Dogsnavigator Website and the Dogsnavigator App. This Privacy Policy explains how we collect, use and disclose information. We, the Service Administration, are committed to protecting the User's privacy (we are the Data Controller).

  1. DEFINITION OF TERMS
    1. Service Administration - Terenbrothers LCC, registered under the laws of Estonia, Registry code: 17071553, and persons duly authorized by it to manage the Dogsnavigator Website and the Dogsnavigator App and provide services to Users who organize and process personal data, as well as determine the purposes of personal data processing, the composition of personal data, that are subject to processing, actions or operations carried out with personal data.
    2. The Dogsnavigator Website - is a collection of data, electronic (digital) information, in particular, objects of copyright and/or related rights, etc., interconnected and structured within the address of the website Dogsnavigator in and/or the account of the owner of such the Service is accessed through an Internet address, which may consist of a domain name, directory or call records, and/or an Internet Protocol numeric address; The Service Dogsnavigator is located at the following link: https://dogsnavigator.com.ua/.
    3. Web page - is a component of the Dogsnavigator Website, located at a special address on the Internet.
    4. The Dogsnavigator App - is software designed to run on smartphones, tablets and other mobile devices that can be downloaded from online mobile application stores such as the App Store, Google Play, Windows Phone Store and others.
    5. Confidentiality of personal data - the requirement not to allow the distribution of personal data (mandatory for compliance by the Administrator or another person who has access to personal data) without the consent of the subject of personal data or the presence of another legal basis, mandatory for compliance by the Administrator or another person who has gained access to personal data.
    6. User - a person who uses the Dogsnavigator Website and Dogsnavigator App and has consented to comply with the Terms of Use, Cookie Policy of the Dogsnavigator Website and Dogsnavigator App.
    7. Personal data - any information relating directly or indirectly to an individual (subject of personal data) that allows the identification of the individual.
    8. Processing of personal data - any action (operation) or set of actions (operations) carried out with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
    9. Cookies - are a small piece of data sent by the web server and stored on the user's computer, which the web client or web browser sends to the web server in an HTTP request whenever trying to open the page of the corresponding Service
    10. IP address - is a unique network address of a node in a computer network built according to the IP protocol.
  2. GENERAL PROVISIONS

    Dogsnavigator attaches particular importance to the respect for the privacy of the Users and of the confidentiality of their personal data, and is thus committed to processing the data in compliance with the applicable laws and regulations, and in particular Law No. 78-17 of 6 January 1978 relating to Information Technology, Data Files and Civil Liberties (hereafter referred to as the “Data Protection Act”), and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereafter referred to as the “GDPR”).

    This Privacy Policy applies to the website: https://dogsnavigator.com.ua/ and to the Dogsnavigator App. This Privacy Policy does not apply to any information collected off the Dogsnavigator Website or Dogsnavigator App or through channels other than this website.

    Data Controller. The data controller for the processing of the personal data referred to herein is Dogsnavigator, a Limited liability company with a share capital of 2 500.00 Euros, registered under the laws of Estonia registration number: 17071553, and whose registered office is located at Harju maakond, Tallinn, Kesklinna linnaosa, Kaupmehe tn 7-120, 10114, has appointed a Data Protection Officer who can be contacted at the following address: Harju maakond, Tallinn, Kesklinna linnaosa, Kaupmehe tn 7-120, 10114.

    The legal grounds for the personal data processing are (within the meaning of Article 6 GDPR):

    (a) Clause “a” of paragraph 1, Article 6 GDPR: the User’s consent of processing the User’s personal data for the purposes stated in Chapter 4 of this Privacy Policy;

    personal data for the purposes stated in Chapter 4 of this Privacy Policy; (b) Clause “b” of paragraph 1, Article 6 GDPR: in case the processing of the User’s personal data is required for the performance of a contract to which the User is the subject

  3. SUBJECT OF PRIVACY POLICY
    1. The current Privacy Policy establishes the obligations of the Service Administration regarding non-disclosure and ensuring the confidentiality protection regime of personal data, which the User provides using Dogsnavigator Website and/or Dogsnavigator App.
    2. Personal data permitted for processing under this Privacy Policy shall be provided by the User at his/her choice in the following way:
      1. By registering an User account on the Dogsnavigator Website by providing the following User information:
        • phone number;
        • full name;
        • date of birth;
        • city of residence;
        • e-mail;
        • user’s photo;
        • password.
      2. By creating a User's dog profile on the Dogsnavigator Website by providing the following:
        1. Mandatory information about dog:
          • dog's name;
          • dog’s breed;
          • gender of the dog;
          • dog's age.
        2. Optional information about the dog:
          • description of the dog;
          • a description of which dog the owner wants to introduce their dog to;
          • information on whether the owner of the dog is interested in breeding the dog;
          • achievements and awards of the dog;
          • locations where the dog is walked.
      3. By publishing ads for the sale or the free transfer of a dog on the Dogsnavigator Website by providing the following:
        • city of residence;
        • dog breed;
        • title of the ad;
        • description of the dog;
        • dog price;
        • photo of the dog (optional).
      4. By posting an announcement on the Dogsnavigator Website about a found or lost dog providing the following:
        • the place where you last saw the dog;
        • the photo of the dog;
        • the dog's breed;
        • the gender of the dog;
        • the name of the dog;
        • description of the ad.
      5. By organizing an event using Dogsnavigator Website providing the following:
        • name of the event;
        • date of the event;
        • time of the event;
        • breed of the dog;
        • description of the event
        • photos and location of the event venue (optional).
      6. By registering an Account in the DogsNavigator App by providing the following User information:
        • phone number;
        • full name;
        • city of residence;
        • e-mail;
        • password;
        • date of birth (optional).
      7. By creating a User's dog profile on the DogsNavigator App by providing the following:
        • dog's name;
        • dog’s breed;
        • dog’s photos;
        • gender of the dog;
        • dog's age;
        • description of the dog;
        • a description of which dog the owner wants to introduce their dog to;
        • information on whether the owner is interested in breeding the dog;
        • achievements and awards of the dog;
        • locations where the dog is walked.
      8. By publishing a post:
        • photo and description of the dog
      9. By using DogsNavigator App:
        • user’s location data
    3. Any other personal information, except the above (browsers, operating systems, etc.), is subject to reliable storage and non-distribution, except for the cases provided in paragraph 5.2. and 5.3. of this Privacy Policy.
  4. PURPOSE OF COLLECTION OF PERSONAL USER INFORMATION
    1. The Service Administration use the information we collect in various ways, including to:
      • Provide, operate, and maintain our Website and App;
      • Improve, personalize, and expand our Website and App;
      • Understand and analyze how you use our Website and App;
      • Develop new products, services, features, and functionality
      • Communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the website, and for marketing and promotional purposes;
      • Send you emails
      • Find and prevent fraud
  5. METHODS AND TERMS OF PERSONAL DATA PROCESSING
    1. The processing of the User's data is carried out without a time limit to achieve the purposes for which they were collected, following the specified Policy. Processing is carried out with the use of automation tools or without the use of such tools in any legal way.
    2. The User agrees that the Service Administration has the right to transfer personal data to third parties (including telecommunications operators, and foreign subjects of relations related to the processing of personal data, inclusive, but not exclusively). We are also authorized to store and use User information to comply with our legal obligations and prevent abuse.
    3. The User's data may be transferred to the authorized bodies of the state authorities of Estonia only on the grounds, conditions, and in the order established by the current legislation.
    4. In case of loss or disclosure of personal data, the Service Administration will inform the User about the loss or disclosure of personal data
    5. The Service Administration takes all available and necessary organizational, technical, and legal measures to protect the User's data from unauthorized or accidental access, destruction, blocking, copying, distortion, distribution, dissemination, and other illegal actions of third parties.
    6. The Service Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's data
    7. Cloud facilities used to store and process user data are located in the data center DigitalOcean(New York): digitalocean.com
    8. Personal data is collected in the following ways:

      (a) Directly from user;

      (b) Directly and indirectly from activity on Dogsnavigator;

      (c) From third parties that interact with Service Administration and/or Dogsnavigator regarding the services provided.

    9. The Service Administration guarantees that, in accordance with this Privacy Policy, personal data, including data on the user's location, is collected and used solely for the purposes provided for in clause 4.1. of this Privacy Policy
  6. RIGHTS AND OBLIGATIONS OF THE PARTIES
    1. The User has the following rights:
      • to know about the sources of collection, the location of their data, the purpose of their processing, the location or place of residence (residence) of the owner or manager of personal data or to give an appropriate mandate to obtain this information to persons authorized by him, except for cases established by law
      • to receive information about the conditions of providing access to personal data, in particular, information about third parties to whom his data is transferred;
      • to have access to your data;
      • to enter a reservation regarding the limitation of the right to process your data when giving consent;
      • to withdraw consent to the processing of personal data;
      • to file complaints about the processing of your data;
      • present a reasoned demand to the owner of personal data with an objection to the processing of his/her data
      • to submit a request for access to, erasure (deletion) or rectification of the personal data;
      • to request the correction of false (inaccurate) personal data;
      • to obtain personal data provided as well as transmit such data to any other personal data controller
      • to submit a complaint concerning the processing of the User’s personal data under this Privacy Policy to the corresponding supervisory authority
    2. The User is obliged to:
      • to provide information containing personal data necessary for using the website Dogsnavigator and Dogsnavigator App;
      • to update and supplement the provided information, which contains personal data, in the event of a change in this information.
    3. The Service administration has the following rights:
      • to receive complete and reliable information from the User if necessary.
    4. The Service administration is obliged to:
      • use the received information exclusively for the purposes specified in section 4 of this Privacy Policy.
      • to ensure that confidential information is kept confidential, not to be disclosed without the prior written consent of the User, as well as not to sell, exchange, publish, or disclose in other possible ways the transferred personal data of the User, except clause 5.3. of this Privacy Policy.
      • to take precautions to protect the confidentiality of the User's data under the procedure that is usually used to protect this kind of information in the existing business turnover.
      • to block personal data related to the relevant User from the moment of application or request by the User or his legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification, in case of detection of unreliable personal data or illegal actions.
  7. EXTERNAL LINKS
    1. Dogsnavigator links to many websites created and maintained by other public and/or private organizations as outlined in our linking policy. If you click on a link to an outside website, you will leave the Dogsnavigator website and are subject to the privacy and security policies of the owners/sponsors of the outside website.
  8. RESPONSIBILITY OF THE PARTIES
    1. In case the Service Administration will not fulfill its obligations under this Privacy Policy, it is responsible for the losses incurred by the User in connection with the improper use of personal data, under the legislation of Estonia, except the cases provided for in paragraph 5.2., 5.3. and 7.2. of this Privacy Policy.
    2. In case of loss or disclosure of Confidential Information, the Service Administration of is not responsible if this confidential information:
      • Became public property until its loss or disclosure
      • It was received from a third party before it was received by the Service Administration.
      • It was disclosed with the consent of the User.
      • It was disclosed due to the fault of the User
  9. ADDITIONAL TERMS
    1. The Service Administration is authorized to update (change) the Privacy Policy without the prior consent of the User.
    2. The last update date of the Privacy Policy will be listed in the “Last Update” line.
    3. The User confirms that he/she has read and understands the provisions of this Policy and accepts the terms and conditions, in particular the provisions on the collection and processing of information about the User's location. The Administration of the Service guarantees to take all necessary security measures, including physical, technical and administrative measures to protect the User's personal information (including information about the User's location).
    4. All suggestions, comments, complaints, requests (related to the Paragraph 6 of this Privacy Policy) or questions regarding this Privacy Policy should be reported by sending a letter to email: service@dogsnavigator.com

    6. In compliance with the requirements of the legislation of Estonia regarding the protection of personal data, we inform you that the controller is a legal entity registered on the territory of Estonia: Harju maakond, Tallinn, Kesklinna linnaosa, Kaupmehe tn 7-120, 10114.
    7. For Users in the European Union, we adhere to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as the General Data Protection Regulation (the "GDPR"). For users in the United Kingdom, we adhere to the GDPR as enshrined in the Data Protection Act 2018. We have not appointed a Data Protection Officer as we do not fall within the categories of controllers and processors required to appoint a Data Protection Officer under Article 37 of the GDPR.
    8. We may amend this Privacy Policy from time to time to maintain compliance with the law to reflect any changes to our data collection process. We recommend you check this Privacy Notice from time to time to ensure you are aware of any changes. If necessary, we may notify you by mail of changes to this Privacy Police.
